Obligations of Rekire.

REKIRE will provide THE CLIENT with the following services from the date of contracting:

Connection:

The hosting will be located on servers permanently connected to the Internet. However, REKIRE cannot guarantee continuous and uninterrupted service availability during the contract period due to potential Internet network problems, server equipment failures, and other unforeseen contingencies. Furthermore, if the domain shares the same machine with other domains, technical problems attributable to third parties may occur, for which REKIRE is not responsible. Therefore, THE CLIENT expressly waives any right to claim any liability, whether contractual or extra-contractual, for damages or losses from REKIRE for any failures, slowness, or errors in accessing and using the contracted service.

Primary and Secondary Servers

REKIRE will provide primary and secondary name servers for THE CLIENT, with REKIRE being responsible for the necessary work for the proper execution of operations and access to them at all times.

Backups

REKIRE performs full backups of all Shared Hosting servers on a regular basis, which may be weekly, bi-weekly, or monthly as deemed necessary. REKIRE will do everything possible to assist the CLIENT in the event of data loss. REKIRE will do everything possible to ensure its backups are performed in good faith.

REKIRE has NO OBLIGATION to perform backups of any hosting plan. The responsibility for performing such backups rests entirely with the CLIENT. The CLIENT has tools available on the server itself to manage their backups, for which they are fully responsible. REKIRE will not be liable for the accidental loss of information due to any external cause. Furthermore, REKIRE cannot guarantee that data from backups can be correctly restored during the recovery process.

Technical Support

REKIRE will provide THE CLIENT, from the date of contracting the service, with all the necessary support and timely technical assistance for the development, expansion and improvement of its activities related to the domains hosted on REKIRE's servers.

REKIRE, through its staff and corresponding technicians, will offer the CLIENT, upon request, technical assistance on aspects related to the contracted services, but will not be able to offer this assistance for issues related to application programming in general, application design, database creation and configuration, consulting, marketing and website development in general terms.

Regarding support and information related to scripts created or produced by REKIRE, such technical support will consist of providing the necessary information on installation. Modifications or changes to the scripts, whether to their pages or code, are excluded. However, upon the express request of THE CLIENT, REKIRE may provide commercial and technical references for CLIENTS or third-party companies that may offer the aforementioned services, which are outside the scope of this agreement.

If the CLIENT has any problems or needs assistance from REKIRE, they must contact the customer area via a ticket system, never by email, as the same level of service cannot be guaranteed through email. Furthermore, using a ticket system ensures proper tracking of communication between the CLIENT and REKIRE.

If the customer contracted the maintenance service with REKIRE, billing will be in 30-minute increments with a stipulated limit of 3 hours per month. If this limit is exceeded, the customer will be billed separately at a rate of €60/hour.

Shared Hosting Server Configuration

REKIRE reserves the right to configure Shared Hosting Servers at its sole discretion. These configurations may be modified without prior notice, whether due to legal obligation, updates to the versions of the services offered, security improvements, etc. It is the client's responsibility to adapt the scripts they use on the Shared Hosting Servers if the normal operation of said scripts is affected by these changes. In any case, REKIRE will attempt to notify all users affected by these changes via email.

Customer obligations

Code of Conduct

REKIRE provides services to various clients and is responsible for providing each client with the best possible service. The following rules have been established to ensure that these obligations can be met. The CLIENT agrees to comply with these rules.

Failure by THE CLIENT to comply with this clause will result in the termination of this contract by REKIRE, without THE CLIENT having the right to claim any compensation.

Minors

The CLIENT acknowledges being of legal age. Otherwise, any contract entered into by minors requires the prior authorization of their parents, guardians, or legal representatives, who will be held responsible for the contract entered into by the minors under their care.

Minors are responsible for obtaining the necessary consent to proceed with the contract. The authorization must be duly signed by their guardian and sent via mail, fax, or email to REKIRE.

Traffic restrictions on virtual hosting plans

The maximum monthly data transfer varies depending on the plan you choose. However, this restriction is not the only one. If a domain consumes a portion of the system's resources to the point that the performance of the other plans hosted on the same server is significantly reduced (typically the case of multiple domains on the same IP address, domains with archives or galleries, p.ej., (e.gif, .jpg, .exe, .tar, etc., and accounts that offer file downloads) REKIRE temporarily disables the domain and will contact THE CLIENT to resolve the issue. This does not mean that the site cannot contain these files.

Prohibited activities

The following activities are strictly prohibited on REKIRE servers:

“spinning” (sending unsolicited electronic advertising communications to those with whom THE CLIENT has no prior business relationship, or sending “off-topic” advertising in newsgroups)

“spoofing” (using a reply email address that is not the sender’s valid reply address or sending an email message that does not contain enough information to allow the recipient to identify the person who is actually sending the message)

“passive spinning” (promoting a website hosted on REKIRE by spamming from another source)

“Trolling” (sending controversial messages to newsgroups with the sole aim of generating responses and disrupting the group's functioning)

“Mailbombing” (flooding a user with email without the intention of establishing correspondence) Generating a higher amount of outgoing mail than the normal user, consuming a portion of the system's resources so that the performance of the other plans hosted on the same server is significantly reduced. Subscribing someone to an email list without that person's permission.

A message is considered unsolicited if it violates the newsgroup's rules ("charter") or if it is sent to a recipient who has not requested the message. Making an email address publicly available does not constitute a request to receive messages.

The distribution of mass email sending programs is also prohibited. All subscribers to a mailing list must have signed up voluntarily and personally.

Mailing lists may not be used to distribute unsolicited messages. If the CLIENT repeatedly engages in mailbombing or attracts such behavior, REKIRE will terminate its contract, and the CLIENT will not be entitled to any compensation.

Respect for the legal rights of third parties

Unacceptable activities in this regard include: Sending or publishing private information about a person without their prior consent. Infringing intellectual property rights. Defaming a person or business. Knowingly publishing code that will have harmful effects on third-party computers.

REKIRE supports freedom of expression on the Internet and will not suspend or terminate the CLIENT's account simply for agreeing or disagreeing with the views expressed by the CLIENT. In the event of allegations that the CLIENT's online activity infringes upon the legal rights of a third party, REKIRE will not act as a judge or adjudicator regarding the decision to be made concerning that third party's claims.

Compliance with the law REKIRE services

They may only be used for legal purposes. Illegal activities include, but are not limited to:

Drug trafficking.

Attempt to access a computer system without authorization.

Piracy (distribution of copyrighted material in violation of copyright laws, particularly files).

MP3, MPEG, ROMs and ROM emulators

Bets.

Fraud and tricks to defraud.

Trafficking in obscene material.

Sending obscene messages or messages with obscene, lewd, lustful, dirty or indecent content with the intention of bothering, harassing, threatening or bullying another person.

Threats of physical harm to other individuals or groups.

Harassment.

Violation of Spanish laws (since REKIRE is Spanish and where the REKIRE.COM servers are located).

Violation of the laws of the country in which THE CLIENT carries out its activities.

Links to illegal materials.

REKIRE reserves the right to check files contained on its servers for illegal materials and content, or for any other reasons it deems necessary.

Pornography

Pornography and the marketing of products of a sexual nature, or links to such materials, will only be acceptable if their content is legal.

Hacking/Cracking

REKIRE reserves the right to report illegal activities to the police or any administrative or governmental authority for prosecution.

Abuse of server resources

Running unauthorized programs on REKIRE servers without prior written authorization is prohibited. Furthermore, using more than 20% of system resources constitutes an undue overload on the server and is unacceptable.

If system usage exceeds 20% of total resources, the CLIENT will be contacted to resolve the issue. Additionally, if a domain or website exceeds its monthly contracted usage, it may be canceled without prior notice. All shared hosting plans are limited and contracted based on monthly storage and traffic.

However, it's possible that the CLIENT's account may consume significantly more resources on the Apache server, MySQL, RAM, or disk to the point where it begins to affect other users on the server. For this reason, REKIRE will measure the Apache log size of the CLIENT's domains. If any domain exceeds the contracted size, the CLIENT will be required to migrate to a higher-level server or plan. You can request the log consumption of any domain from the support department at any time to stay informed about its usage. This ensures that the servers do not become overloaded and function optimally for all users sharing them.

Other behaviors

The following examples are not exhaustive and are provided as guidelines for behavior. The CLIENT may contact REKIRE if unsure whether their actions constitute a violation of our policy.

Sending intrusive messages to any network

Attempts to bypass user authentication or security measures on a server, network, or account.

Access to data not directed at the user.

Security survey of any network.

Creation (“spawning”) of dozens of processes.

Port scanning, “ping floods”, packet “spoofing”, router information forgery, attacks.

“Denial of Service”, “sniffers”, “flooding”, “spoofing”, “ping bombing”, “smurfs”, “winnuke”, “land”, “teardrop”.

Virus Promulgation.

IRC bots such as eggdrop or BitchX. Any activity, whether or not it results in data corruption or loss, will be investigated, and appropriate measures will be taken.

The presence of any of these programs, whether or not executed, will cause REKIRE to take action against THE CLIENT, including the suspension or termination of the contract, without THE CLIENT having the right to claim any compensation.

Server administration – SLA (Service Level Agreement)

REKIRE server administration includes:

Update of all versions and technologies.

Kernel update, Directadmin and libraries.

Custom operating system configurations.

24/7 server monitoring.

Any migration to a superior product.

If THE CLIENT wishes to change to a lower-quality product, THE CLIENT is responsible for migrating their data.

REKIRE server administration does NOT include:

The installation of software or hardware not directly related to the operating system or control panel.

Any additional software installation will be quoted, and you must have accepted and paid the quote for the operation.

Solving problems with the scheduling of files, scripts or applications uploaded and used by THE CLIENT or updates thereof.

Migrations from other providers to REKIRE. The CLIENT is responsible for ensuring that their migration has been carried out successfully.

At no time will REKIRE administrators be obligated to provide support for a migration or technical problem with a provider external to REKIRE.

The fee for interventions that are NOT included in the administration of the services offered will be €60/hour, VAT not included, and may vary depending on the work or service to be performed.

The CLIENT is solely responsible for any attacks exploiting vulnerabilities in the files, scripts, or applications they use. The CLIENT is solely responsible for updating their files, scripts, and/or applications and ensuring they have the lowest possible execution permissions. The CLIENT is responsible for any damage caused by attacks on their server originating from their files, scripts, or applications (Apache, FTP, email, MySQL, etc.).

Maintenance of REKIRE systems

REKIRE is authorized to disconnect the contracted line in all cases where this is necessary to carry out any adjustment, modification, or improvement, as well as for the repair of any faults. REKIRE will endeavor, to the extent possible, to notify the CLIENT via email before carrying out any disconnection.
